Terms and conditions sms&park:
1. sms&park is an electronic system for mobile parking space management. It allows cashless payment of parking fees by mobile phone without requiring parking users to register in advance.
2. Parking fees are considered to be paid when the parking space user has received the confirmation SMS. The confirmation SMS serves as proof of payment.
3. Parking is charged for at the applicable rates set by the local authority. Please refer to the information in the service conditions displayed on ticket machines for the maximum permitted parking time.
4. There is no additional charge for using sms&park. Use of the sms&park system is included in the price of the parking fee. The SMS sent to request the ticket will only be charged at the user's standard SMS rate. Users should contact their mobile communications provider for details of the applicable SMS charges.
5. Charges either appear on the user's mobile phone bill or are deducted from a pre-paid balance.
6. The user's legal relationship with the local authority resulting from the act of parking shall not be affected by the use of sms&park to pay parking fees via a mobile phone.
7. If it is not possible to pay parking fees via mobile phone due to temporary unavailability of the service, then the parking user shall still be responsible for payment of the parking fee. In such cases an alternative method of payment must be used, such as purchasing a ticket from the ticket machine (in Germany, the 11th Exemption Amendment to German Road Traffic Regulations shall apply). The same shall apply if the parking user does not receive a confirmation SMS, as this means the user cannot assume the parking fee was paid successfully. The system operator will not accept any liability for costs arising from non-payment of parking fees.
8. In the event that a user receives a parking ticket (parking fine) from the local authority parking service despite having paid the appropriate fee using sms&park, the confirmation SMS shall be valid as proof of payment.
9. All personal data relating to the parking user will be processed in accordance with locally applicable data protection legislation.
10. The system operator shall only be liable in cases of culpable negligence that have led to injury, death or damage to health, or in cases of deliberate or gross negligence. The system operator specifically disclaims all liability for unavailability of the sms&park service or the mobile communications network. Similarly, no liability is accepted for non-transmission or incomplete transmission of the content of an SMS.
11. The parking user shall consent to receive promotional information alongside the messages received in relation to sms&park (confirmation SMS, reminder SMS).

1. sms&exit is an electronic system for paying parking fees by mobile phone. It allows cashless payment of parking fees by mobile phone without requiring parking users to register in advance.
2. Parking fees are considered to be paid when the parking space user has received the confirmation SMS. The confirmation SMS serves as proof of payment.
3. Parking is charged for at the applicable rates set by the local authority. With sms&exit the payment amount is calculated by the central computer of the barrier system. The amount due when leaving the car park will be charged automatically after requesting the ticket ID via SMS.
4. There is no additional service charge for using sms&exit. Use of the sms&exit system is included in the price of the parking fee.
The SMS sent to request the ticket will be charged at the standard SMS rate (transport fee) by the user's mobile network operator.
5. Charges either appear on the user's mobile phone bill or are deducted from a pre-paid balance. Receipts are available for download from the www.sunhill-technologies.com website.
6. The user's legal relationship with the car park operator resulting from the act of parking shall not be affected by the use of sms&exit to pay parking fees via a mobile phone.
7. If it is not possible to pay parking fees via mobile phone due to temporary unavailability of the service, then the parking user shall still be responsible for payment of the parking fee. In such cases an alternative method of payment must be used, such as paying at the ticket machine.
The same shall apply if the parking user does not receive a confirmation SMS, as this means the user cannot assume the parking fee was paid successfully. In that case it is the user's responsibility to check at a payment machine that payment was indeed made and if necessary to pay at the machine.
sunhill technologies GmbH will not accept any liability for costs arising from non-payment of parking fees.
8. In the event that a user makes an additional payment at the payment machine despite having paid the appropriate fee using sms&exit, the confirmation SMS or the mobile phone bill shall be valid as proof of payment and the excess amount paid shall be reimbursed by sunhill technologies GmbH.
